General Terms and Conditions Viva La Vida Yoga Retreats, Workshops and Courses

1.1 General conditions: the general terms and conditions used by Viva La Vida Lifestyle, which are published on the website of Viva La Vida Lifestyle, www.vivalavidalifestyle.com.

1.2 Booking form: application for the Workshops, Courses and/or Retreats will take place by sending the booking form and doing the payment of the (non refundable) deposit or the total amount. Viva La Vida Lifestyle will confirm the booking after receipt of the booking form and payment of the deposit.

1.3 Participant: a person who joins or wants to join a yoga Workshop, Course or Retreat from Viva La Vida Lifestyle.

1.4 Advance payment (deposit): To do a booking for a Retreat, Workshop or Course the participant shall pay Viva La Vida Lifestyle a non-refundable deposit of the total amount due for each person named in the reservation.

1.5 Viva La Vida Lifestyle: Viva La Vida Lifestyle is based in The Hague at the Perponcherstraat 95, 2518 SP and registered in the Commercial Register under number KVK 55 41 33 58 and VAT number NL 8516.97.665 .B.0.

1.6 Price: the total price of the Retreat Course or Workshop, including the deposit.

1.7 Retreat, Course, Workshop: an event in the form of a Retreat, Workshop or Course organised by Viva La Vida:

  1. Applicability

2.1 The General Terms and Conditions apply to all Retreats, Courses and Workshops.

At the time of sending a booking request for a Retreat, Course and Workshop, the participant agrees to the Terms and Conditions and the payment of the relevant Retreat, Course or Workshop deposit.

2.2 Viva La Vida Yoga may revise these General Terms and Conditions from time to time. The latest version of the General Terms and Conditions is always the current version and is always available on the Website.

  1. Participation Workshop, Cursus c.q. Retreat and Entry fee

3.1 A Participant may participate in a Workshop, Course c.q. Retreat after the participant has send the booking form and has paid the price. You can register through the website or by e-mail to info@vivalavidalifestyle.com. Your spot in the Workshop, Course or Retreat is guaranteed after Viva La Vida Lifestyle has received the deposit or complete payment. Furthermore Viva La Vida Lifestyle might do a brief telephone interview or send a questionnaire in order to complete the booking. Viva La Vida Lifestyle will send a confirmation to the participant.

3.2. Viva La Vida Lifestyle reserves the right to offer discretionary discounts and this does not affect the status of any guests who have paid the full price and no discount will then become due to them.

  1. Payment

4.1 For participation in a Workshop, Course or Retreat the Payment has been completed before the start of the Workshop, Course or Retreat. The Payment can be done via a direct bank transfer to the bank account of Viva La Vida Lifestyle, or can be done directly  via PAYPAL, iDEAL or Credit Card.

4.2 When participating in a Workshop, Course or Retreat, the non-refundable deposit should paid no later than 7 days after booking confirmation.

The remaining amount shall be paid, not later than 30 days before the start of the scheduled Workshop, course or Retreat.

4.3 When booking less than 30 days before the start of the Workshop, Course or Retreat, the amount should be paid immediately (within 48 hours).

4.4 If payment of either the deposit or the balance is not received by the due date Viva La Vida Lifestyle reserves the right to cancel the reservation and retain the deposit.

5 Cancellation Retreat, Course or Workshop participation

5.1 Cancellation of participation in the planned Retreat, Workshop or Course can only be done only in writing. This can be done by email to info@vivalavidalifestyle.com.

5.2 In the event of cancellation by the participant, regardless of the circumstances, the following refund fees, minus the deposit, apply. The deposit is non-refundable, as mentioned in 1:

Cancellation more than 8 weeks before due arrival date, 100% refund

Cancellation 4 to 8 weeks before due arrival date, 50% refund

Cancellation 4 weeks or less before due arrival date, 0% refund

5.3 If the participant is unable to attend a Course, Workshop or Retreat, the participant might in consultation with Viva La Vida Lifestyle transfer it to another person. The participant has to discuss this with Viva La Vida Lifestyle at least 5 days  before the start of the Workshop, Course or Retreat.

5.4  If the Retreat or course participant on site, for any reason, is unable to participate in the Retreat, Workshop or Course, the price already paid will not be refunded.

5.5  The participation in the program during the Retreat, Workshop or Course is voluntary. The participants are free to opt out of the program. Once the Retreat, Workshop or Course has begun, no refund or part refund or unused portion of the Retreat, Workshop or Course will be repaid in the event of cancellation by you. Bookings are for the stated period of the retreat.  If the reason for cancellation is covered under the terms of your own Insurance Policy, you may be able to make a claim.

  1. Cancellation of Retreat, Course or Workshop by Viva La Vida Lifestyle

6.1 Viva La Vida Lifestyle reserves the right in any circumstances (like insufficient participants, the teacher’s illness or other situations beyond our control) to cancel or change a retreat.  Viva la Vida Lifestyle shall inform the customer as soon as possible. Alternative arrangements will be offered if possible or we will offer a full refund of all monies paid within 10 working days.

6.2  Viva La Vida does not accept responsibility for any costs incurred.

6.3. Viva La Vida Lifestyle is not held liable for flight costs.

  1. Amendments by Viva La Vida Lifestyle

Occasionally, changes may have to be made (e.g., yoga teacher, program, class times or other arrangements), which we reserve the right to do at any time.

If your accommodation has to be changed for any reason, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

  1. Travel Arrangements Participant

8.1  It is the  responsibility of the participant to check the reservation and ensure that the particulars contained therein are correct.

8.2 All travel arrangements not included in the Retreat, Course or Workshop are your responsibility and at your own cost. Transfers to/from the retreat are at your own cost, unless otherwise specified.

8.2 It is the customer’s responsibility to ensure that he/she has all the relevant travel documentation and arrives at the airport in time.

9 Travel Insurance


9.1 Insurances are not included in the price you pay.

Since we cannot be liable for any accidents or injuries or damages to property which occur during your stay at one of our retreats, we recommend that you take a travel insurance/ cancellation insurance for your trip that covers the activity of the Retreat, Workshop or Course as well as unexpected cancellation, sickness, losses and all the usual risks. . We are not liable for any traveling delay, strikes, lost baggage or injuries, or damages of any kind.

  1. Health of the Participant / Medical disclaimers

10.1 The yoga & meditation sessions as offered are intended for recreation and not as a substitute for necessary medical treatment or therapy. Discuss physical and / or psychological symptoms, therefore, always with a qualified physician.

10.2 Tell the teacher before the class if you have physical problems. The teacher can adapt or add personalized exercises to the program. Do not force anything and take physical symptoms seriously. Participation is always at your own risk.

10.3 If you have a medical condition, serious or otherwise, you MUST inform Viva La Vida Lifestyle at the time of booking and we can ask to provide a letter from your GP confirming that it is safe for you to attend a Viva La Vida Lifestyle Retreat, Workshop or Course with our diet, yoga classes & and other physical activities that we arrange. In the interests of your well being we may decide to decline your stay at our Retreat, Workshop or Course.

10.4 If an emergency arises we will do everything in our power to assist you but Viva La Vida Lifestyle is not responsible for the outcome of any such emergency.

10.5 Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain

10.6 A participant must always stop and rest if he/she is feeling any pain or sickness and inform the teacher of any previous injuries.

10.6 Pregnancy: Unless you have been a regular yoga practitioner for several years it is not advisable to practice yoga during the first trimester, particularly if there is any history of miscarriage. During the remainder of pregnancy it is more suitable to attend pregnancy yoga classes. However, if you have been a regular yoga practitioner for several years and your internal muscles are used to yoga postures and if you have a letter from your doctor stating that it is safe for you to engage in the activities that we provide, then you might in  in consultation with Viva La Vida Lifestyle attend a Workshop or Retreat during your second and third trimester. Guidance from our yoga teacher must be observed.

  1. Our liability

11.1 We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

11.2  We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, accidents or failure to perform by third parties, including suppliers and subcontractors, unforeseen changes in your personal circumstances or other events beyond our control.

11.3 We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel.

11.4 We are not liable for any injuries you may incur. The Retreats, Workshops or Courses are undertaken at your own risk. We are not liable for any medical or psychiatric conditions which may develop during or subsequent to the Retreat, Workshop or Course. You hereby agree to waive claims against Viva La Vida Yoga’s staff for any injury and any damage that you may incur, which may be associated with participation in the Classes, Workshops, Retreats and Courses.

11.5 Viva La Vida Lifestyle cannot accept any responsibility for loss or damage of personal possessions or valuables of the customer.

11.6 We are not responsible for the individual behaviour of any guest.

11.7a We accept no responsibility for keeping the website up to date and will not be liable for any loss by its failure to do so. We are not responsible for the contents of any links displayed on our website.

  1. Participant Behavior

12.1 Viva La Vida Lifestyle expects the participants to behave respectfully to each other and the organization. When misconduct occurs(drugs and excessive alcohol consumption, aggressive behavior, harassment, vandalism or theft), the participant will be excluded from further participation in the program.

12.2 The customer shall keep all fixtures, fittings, furniture and effects on the Workshop, Retreat or Course Location in a clean and good condition and shall replace any articles which are destroyed or missing with articles of a similar kind and of equal value.

  1. Use of Mobile Phones and WiFi Devices

Mobile phones and other WiFi devices may be used within the property, but we ask the participants to limit the use as much as possible. Our Retreats, Courses and Workshops are designed for people to be relaxed and reflective. Please be discrete when talking on your phone. Listening to music on headphones is permitted at moderate volume so as not to disturb other guests.

  1. Group Bookings

Where a booking is made on behalf of several individuals the booking is conditional on the person signing the booking form having authorisation from all the individuals named on the booking form to enter into this contract. A deposit from every group member is required. If any member of the group can not come for any reason, their deposit is forfeit.

  1. Complaints

If you have a problem during your Retreat, Workshop or Course please inform the manager immediately and he/she will endeavour to put things right. Any retrospective complaint must be made in writing to Viva La Vida Lifestyle within 14 days of the end of your Retreat, Course or Workshop
